Intelligence And Investigation Agencies Of India & Other Countries

National security depends not only on the strength of the armed forces but also on the ability to detect threats before they become serious. In India, intelligence and investigation agencies perform this role through information gathering, surveillance, analysis, investigation and coordination. Organisations such as the IB, R&AW, NIA, CBI, ED, and DIA have different areas of responsibility, ranging from espionage and terrorism to financial crimes, cyber threats and defence intelligence. Together, they form an important part of India’s security and law-enforcement framework.

Intelligence Agencies of India and their Functions:

Intelligence Bureau (IB) -

The Intelligence Bureau (IB) is India’s principal internal intelligence organisation and functions under the Ministry of Home Affairs (MHA). Its origins go back to 1887. It focuses on threats within India and also performs counter-intelligence functions.

Its work includes monitoring terrorism, insurgency, Left-Wing Extremism, espionage and other threats to internal security. IB intelligence is shared with relevant central and state authorities for preventive and security measures. The MHA specifically lists the IB among organisations associated with internal security.

Research and Analysis Wing (R&AW) -

The Research and Analysis Wing (R&AW) was established in 1968 after the need for a specialised external intelligence organisation became evident following the security challenges of the 1960s. It is associated with the Cabinet Secretariat and deals primarily with intelligence concerning developments outside India.

It is not liable to the parliament of India on any issues and the same provision keeps it out of reach of the Right to Information (RTI) act.

R&AW collects and analyses information relating to foreign governments, military developments, geopolitical changes, terrorism, strategic threats and developments affecting India’s national interests. Its role is therefore different from the IB as IB primarily deals with internal intelligence, while R&AW focuses on external intelligence.

National Investigation Agency (NIA) - Counter-Terrorism Investigation

The National Investigation Agency (NIA) was created under the NIA Act, 2008, enacted in the aftermath of the 26/11 Mumbai attacks. It functions as India’s central counter-terrorism law-enforcement agency.

Unlike the IB and R&AW, the NIA is principally an investigative and prosecuting agency. It investigates offences listed in the Schedule to the NIA Act and other connected offences within its statutory jurisdiction.

The 2019 amendment expanded the framework of the NIA Act, including provisions concerning certain offences having implications beyond India and offences such as human trafficking and cyber-terrorism within the statutory framework.

Central Bureau of Investigation (CBI) -

The Central Bureau of Investigation (CBI) is one of India’s major central investigative agencies. It originated from the Delhi Special Police Establishment (DSPE) and was given its present name in 1963.

The CBI investigates cases involving corruption, economic offences, serious crimes and other matters entrusted to it. Its legal framework is closely connected with the Delhi Special Police Establishment Act, 1946.

The CBI also serves as India’s National Central Bureau (NCB) for Interpol, facilitating cooperation between Indian law-enforcement authorities and international police agencies.

Defence Intelligence Agency (DIA) - Military Intelligence

The Defence Intelligence Agency (DIA) was established in 2002 to improve coordination among the intelligence capabilities of the three armed forces.

It functions under the Ministry of Defence through the Integrated Defence Staff and focuses on military and strategic intelligence.

Enforcement Directorate (ED) - Financial Investigation

The Enforcement Directorate (ED) is a specialised financial investigation agency under the Department of Revenue, Ministry of Finance.

Its two major legal frameworks are:

● Prevention of Money Laundering Act, 2002 (PMLA)

● Foreign Exchange Management Act, 1999 (FEMA)

Under PMLA, the ED investigates money laundering and proceeds of crime, while under FEMA it deals with specified contraventions relating to foreign exchange. This makes financial investigation an important part of modern national security because terrorist organisations, organised crime networks and other illegal groups may depend upon financial channels.

Directorate of Revenue Intelligence (DRI) - Anti-Smuggling Intelligence

The Directorate of Revenue Intelligence (DRI) functions under the Central Board of Indirect Taxes and Customs (CBIC) and is India’s specialised agency dealing with customs-related intelligence and anti-smuggling activities.

It works against illegal cross-border movement of goods and customs fraud.

Its work may involve intelligence and investigation concerning:

● Gold smuggling

● Narcotics

● Wildlife products

● Prohibited/restricted goods

● Customs duty evasion

● Commercial fraud

Thus, DRI connects intelligence gathering with customs enforcement.
