SENIOR CITIZEN ACT 2007

Welfare provisions and rights under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (often referred to as the Senior Citizens Act) in India — the core law protecting senior citizens’ welfare:

1. Definition and Purpose

- A senior citizen under the Act is any Indian citizen aged 60 years or above.

- The main purpose is to ensure maintenance, protection, dignity, and welfare of senior citizens so they can live with security and respect.

2. Right to Maintenance

This is the most central right under the Act:

- A senior citizen who is unable to maintain themselves from their own income or property has the right to claim maintenance.

- “Maintenance” includes provision for food, clothing, residence, medical attendance, and treatment.

- The Act imposes a legal obligation on children and legal heirs to provide maintenance to senior citizens.

How it works

- The senior citizen (or a representative association) can file an application to the Maintenance Tribunal in the concerned district.

- The Tribunal can order children/relatives to pay monthly maintenance to ensure the senior citizen’s basic needs are met.

- Proceedings are meant to be speedy, inexpensive, and accessible, so senior citizens get quick relief.

- Failure to comply with the Tribunal’s order can lead to enforcement actions, such as warrants or even imprisonment, until payment is made.

3. Protection of Life and Property

The Act contains provisions aimed at protecting the rights of senior citizens beyond financial maintenance:

- Transfers of property by senior citizens made under fraud, coercion, or undue influence (e.g., with a promise of care) can be declared void if the receiving party fails to honour maintenance obligations.

- This protects senior citizens from being exploited through property deals that leave them without support.

4. Welfare Measures

The Act empowers state governments to take welfare initiatives for elderly persons. These include (but are not limited to):

Old Age Homes

- State governments may establish old age homes and ensure their operation to provide shelter and care.

Healthcare and Support Services

- Governments may facilitate healthcare services catering to senior citizens’ needs.

- Although the Act itself uses “may” (not “shall”), policy measures often include separate healthcare support beyond the Act.

Recreation and Social Integration

- Welfare may include provisions for social and recreational amenities and welfare programmes intended to reduce isolation and support emotional well-being.

5. Maintenance Tribunals and Appeal

- The Act establishes Maintenance Tribunals at the district level to handle cases.

- Tribunals are meant to resolve applications quickly (usually within 90 days).

- Decisions of the Maintenance Tribunal can be appealed to an appellate authority.

6. Free Access and Procedure

- Filing an application does not require any fee.

- The procedure before the Tribunal is designed to be simpler and less formal than regular courts.

7. Additional Rights & Protections

While these are not always codified strictly within the Act, broader senior citizen welfare and rights recognised in policy and law include:

- Right to public assistance in cases of old age, sickness, disability, or undeserved want.

- Certain fiscal benefits, such as income tax concessions, for senior citizens and super senior citizens, also called as very senior citizens ( 80 + years ) in the Income Tax Act.

Note:

If senior citizens are misbehaved, mal-treated by their children or legal heirs, they can take help of local police by dialling 100 or 112 or 1291 (Senior citizen helpline) for immediate redressal of their grievances. They can approach the local police station for necessary help. The police will provide necessary help to them and will protect their dignity. Our government is committed to taking care of our senior citizens. Under Ayushmaan mission senior citizens above the age of 70 years are entitled for free medical treatment upto the value of Rs.10 Lakhs ( Rs 5 Lakhs by Union government + Rs 5 Lakhs by Delhi government) in government hospitals..
